Privacy Policy

1. Scope and Acceptance

This Privacy Policy explains how Next Windows & Doors ("Next Windows & Doors," "we," "us," or "our") collects, uses, shares, and protects personal information when you visit nextwindowsanddoors.com (the "Site"), use our online estimate tool, respond to our ads or lead forms, call or text us, book or attend a consultation, or otherwise do business with us (together, the "Services"). By using the Services or giving us your information, you acknowledge that you have read this Policy and agree to its terms. If you do not agree, please do not use the Services.

"Personal information" means information that identifies you or your household, or that could reasonably be linked to you or your household. It does not include information that has been de-identified or combined so that it can no longer be tied to you.

2. Information We Collect

Information you give us directly

  • Online estimate tool. Your project details, such as the number, type, size, and style of windows and doors, options you select, your property address or ZIP code, and the estimate we generate, along with your name, phone number, and email address.
  • Contact and booking forms. Your name, phone number, email address, property address, preferred contact times, and anything you choose to include in your message.
  • Facebook and Instagram lead forms. When you submit one of our lead forms on Meta's platforms, Meta passes us the information you submit, such as your name, phone number, email address, ZIP code, project details, timeframe, and whether you own the home.
  • Phone calls, texts, and emails. Your phone number, the content of your messages, and call details. Calls may be recorded and kept for quality, training, and record-keeping purposes where permitted by law, and we will tell you when a call is recorded if the law requires it.
  • Consultations and projects. Information we gather during an in-home or virtual consultation or while performing work, such as measurements, photos of the areas being worked on, product choices, scheduling details, contract and payment information, and notes about your project. If you ask about financing, information you provide to a financing provider is handled by that provider under its own privacy policy.

When you use the Site, we and our service providers automatically collect certain technical information, including your IP address, browser and device type, operating system, approximate location based on IP address, referring website, pages viewed, links clicked, time spent on pages, and the date and time of your visit. We collect this through cookies, pixels, tags, and similar technologies (see Section 6).

We may receive information about you from advertising and social media platforms, referral sources, publicly available records (such as property records), and service providers who help us run our business.

3. How We Use Your Information

We use personal information to:

  • Prepare estimates, respond to your questions, and schedule and conduct consultations;
  • Provide, install, and service the products you purchase, and coordinate permits, deliveries, and installation;
  • Contact you by phone, text, and email about your inquiry, appointment, or project;
  • Send marketing and promotional messages where you have agreed to receive them;
  • Operate, maintain, secure, and improve the Site and the Services;
  • Measure and improve our advertising, including showing relevant ads on other websites and platforms;
  • Process payments and keep business and tax records;
  • Detect, prevent, and respond to fraud, misuse, security incidents, and other harmful activity;
  • Comply with legal obligations and enforce our agreements; and
  • Establish, exercise, or defend legal claims.

4. Phone Calls and Text Messages (SMS) Consent

By providing your phone number on our Site, through a Facebook or Instagram lead form, or in any other way, and checking any consent box or submitting the form, you expressly agree that Next Windows & Doors and service providers acting on our behalf may contact you at the number you provided, including any mobile number, by phone call and text message about your inquiry, estimate, appointment, project, and, where you have agreed, offers and promotions. These calls and texts may be made using automated technology, an automatic telephone dialing system, or artificial or prerecorded voice messages. You agree to receive these communications even if your number is listed on a federal, state, or internal do-not-call list.

  • Consent is not a condition of purchase. You do not have to agree to receive calls or texts to buy any product or service from us. You can call us directly at (401) 240-1268 instead.
  • Message frequency varies depending on your inquiry and project.
  • Message and data rates may apply, according to your mobile carrier's plan.
  • Opting out. Reply STOP to any text message to stop receiving texts. We may send one final message confirming your opt-out. You can also ask us to stop calling you at any time by telling us during a call, calling (401) 240-1268, or emailing privacy@nextwindowsanddoors.com.
  • Help. Reply HELP to any text message, or call (401) 240-1268, for assistance.
  • Carriers are not liable for delayed or undelivered messages.
  • Your number. You confirm that you are the owner or authorized user of the phone number you provide. Please let us know promptly if you change or give up that number.
  • No sharing of mobile information. We do not sell, rent, or share mobile phone numbers, text messaging opt-in data, or consent with third parties or affiliates for their own marketing or promotional purposes. This information is shared only with service providers that help us operate our calling and texting services (such as messaging platforms and carriers), and only so they can provide those services to us. None of the sharing described in Section 5 includes text messaging opt-in data or consent.

5. How We Share Your Information

We do not sell your personal information, and we do not share it with third parties for their own marketing. We share personal information only as follows:

  • Service providers. With companies that perform services for us, such as website hosting and development, customer relationship management, phone and text messaging, email delivery, scheduling, payment processing, analytics, advertising, IT support, and accounting. They may use your information only to provide services to us.
  • Installation and product partners. With manufacturers, suppliers, installers, subcontractors, and other partners who help us measure, order, deliver, install, and warranty your products, and only as needed for your project.
  • Financing providers. If you ask about or apply for financing, with the financing provider you choose, as needed to process your request.
  • Legal and safety reasons. When we believe in good faith that disclosure is required by law, subpoena, court order, or government request; to enforce our Terms of Service or contracts; to protect the rights, property, or safety of our business, our customers, or others; or to detect and prevent fraud or security issues. We may also share information with our attorneys, insurers, and accountants.
  • Business transfers. In connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, or in a bankruptcy or similar proceeding, personal information may be transferred to the buyer or successor and their advisors.
  • With your consent. For any other purpose with your permission.

We may also share information that has been aggregated or de-identified so it no longer identifies you.

6. Cookies, Analytics, and Advertising

We and our partners use cookies, pixels, tags, and similar technologies to make the Site work, remember your preferences, understand how visitors use the Site, and measure and personalize advertising. These include:

Other choices:

  • Opt out of interest-based ads from many companies through the Digital Advertising Alliance at https://optout.aboutads.info and the Network Advertising Initiative at https://optout.networkadvertising.org.
  • Most browsers let you block or delete cookies in their settings. Opt-outs usually apply only to the browser and device you use, so you may need to repeat them on each device. If you block cookies, parts of the Site may not work properly.
  • Global Privacy Control. Where required by law, we honor Global Privacy Control (GPC) browser signals as a request to opt out of targeted advertising for that browser or device.

Some of these activities may be considered "targeted advertising" under certain state privacy laws. See Section 10 for your rights.

7. Third-Party Links and Platforms

The Site may link to, or be accessed through, third-party websites and platforms, including Facebook, Instagram, Google, review sites, manufacturer websites, and financing providers. We do not control these third parties and are not responsible for their content, privacy practices, or security. Information you post publicly on social media, such as comments and reviews, can be seen and used by others. Please review the privacy policies of any third party you interact with.

8. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, such as encrypted (HTTPS) connections, access controls, and trusted service providers. However, no method of transmitting or storing information over the internet or electronically is 100% secure, and we cannot guarantee absolute security. You share information with us at your own risk, and you are responsible for keeping any passwords or account details confidential. If we learn of a security breach affecting your personal information, we will notify you as required by law.

9. Data Retention

We keep personal information only as long as reasonably necessary for the purposes described in this Policy, including to complete your project, honor warranty and service obligations, keep business, tax, and contract records, resolve disputes, enforce our agreements, and meet legal requirements. When deciding how long to keep information, we consider legal retention requirements, statutes of limitations, pending or threatened legal claims, and the nature of the information. When it is no longer needed, we delete, de-identify, or securely dispose of it.

10. Your Rights and Choices

Choices available to everyone:

  • Marketing emails: click "unsubscribe" in any marketing email.
  • Texts: reply STOP to any text message.
  • Calls: ask us to stop calling, or contact us using the details below.
  • Cookies and ads: use the options in Section 6.

We may still contact you about an active inquiry, appointment, or project where permitted by law.

Rhode Island and other US state privacy rights. Depending on where you live and whether a law applies to us, residents of Rhode Island (under the Rhode Island Data Transparency and Privacy Protection Act) and of other states with consumer privacy laws may have the right to:

  • Know and access the personal information we have about you, and the categories of third parties we disclose it to;
  • Correct inaccurate personal information;
  • Delete personal information, subject to legal exceptions;
  • Obtain a portable copy of your personal information;
  • Opt out of targeted advertising, the sale of personal information, and profiling that produces legal or similarly significant effects;
  • Appeal our decision on your request; and
  • Not be discriminated against for exercising these rights.

How to make a request. Email privacy@nextwindowsanddoors.com or call (401) 240-1268. Please tell us your name, the email address or phone number you used with us, and what you are requesting. We will verify your identity before acting on your request, and we may ask for more information to do so. An authorized agent may make a request for you if they provide signed written permission, and we may still ask you to verify your identity. We will respond within the time required by applicable law. If we deny your request, you may appeal by emailing privacy@nextwindowsanddoors.com with the subject line "Privacy Request Appeal." If you are not satisfied with the outcome of your appeal, you may contact your state Attorney General.

These rights are not absolute. We may decline or limit a request where permitted by law, such as when we must keep information to complete a contract, honor a warranty, comply with the law, or defend legal claims.

11. Do Not Track

Some browsers send "Do Not Track" signals. Because there is no common standard for how to respond to these signals, the Site does not currently respond to them. We do honor Global Privacy Control signals as described in Section 6 where required by law.

12. Children's Privacy

The Site and Services are not intended for anyone under 18. We don't knowingly collect information from anyone under 18. If you believe a person under 18 has given us personal information, please contact us at privacy@nextwindowsanddoors.com, and we will delete it.

13. Limitation of Liability

To the fullest extent permitted by law, Next Windows & Doors and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from or related to this Policy, the Site, or the collection, use, or disclosure of personal information. This includes unauthorized access to or use of information caused by third parties, such as hackers, platform providers, or service providers, that is outside our reasonable control. Nothing in this Policy limits any rights you have that cannot be waived under applicable law.

14. Changes to This Policy

We may update this Policy at any time. The updated version will be posted on this page with a new "Last updated" date and takes effect when posted. If we make material changes, we may also give additional notice, such as a notice on the Site. Your continued use of the Site or Services after changes are posted means you accept the updated Policy. Please review this page periodically.

15. Governing Law

This Policy and any dispute relating to it are governed by the laws of the State of Rhode Island, without regard to its conflict-of-law rules, except where the privacy laws of your state of residence require otherwise.
